A Fulton County grand jury has indicted 15-year-old Kroy “KJ” Biermann Jr. on seven felony counts tied to an alleged April incident in Alpharetta.
Biermann Jr. is the son of former Atlanta Falcons player Kroy Biermann and former Real Housewives of Atlanta star Kim Zolciak. According to court filings and reporting from FOX 5 Atlanta and WSB-TV, he is being prosecuted as an adult.
What the indictment alleges
The seven-count indictment includes aggravated child molestation, aggravated sexual battery, aggravated sodomy, three counts of sexual battery against a child under 16 and false imprisonment.
The case stems from an alleged encounter on April 23 at a Life Time Fitness on North Point Parkway in Alpharetta. Police say the case involves a 15-year-old girl. GAFollowers is not identifying the alleged victim.
Arrest and investigation
Alpharetta police arrested Biermann Jr. on Aug. 17 after investigating the reported encounter. FOX 5 reported that the girl was evaluated at Children’s Healthcare of Atlanta after the incident and that testing did not reveal male DNA.
That detail has become a major part of the defense response. Biermann Jr.’s attorney has said his client is innocent and argued that investigators should have given more weight to evidence presented by the defense, including a polygraph examination.
Kim Zolciak defends her son
Zolciak has also publicly defended her son. In statements reported by multiple outlets, including People, she said he denies the allegations and pointed to the polygraph and DNA findings while asking the public not to treat the accusations as proven.
The indictment means a grand jury found enough evidence for the criminal case to move forward. It is not a finding of guilt, and the allegations have not been proven in court.
