Raffensperger Joins Supreme Court Brief Opposing Last-Minute Mail Rules

Georgia Secretary of State Brad Raffensperger has joined a bipartisan group of current and former election officials asking the U.S. Supreme Court to keep new Postal Service mail-verification requirements from taking effect immediately before the November election.

The emergency friend-of-the-court filing includes 38 election officials nationwide, according to WSB-TV. Georgia election directors from Cherokee, Lowndes, Morgan, Muscogee and Paulding counties also joined the effort.

Why officials object to the timing

The dispute centers on proposed procedures for election mail, including new envelope and verification steps. Election administrators told the court that changing those processes close to Election Day could create operational problems after forms, vendor instructions and voter materials have already been prepared.

Their brief focuses on implementation timing rather than asking the justices to decide whether every proposed rule is lawful. The officials argue that any major change should be delayed until after the election so state and local offices have time to adjust.

The compressed calendar is especially important for military and overseas ballots. Federal law requires those ballots to be transmitted well before Election Day, leaving administrators little room to redesign workflows during the voting period.

What happens next

The Supreme Court had not issued a final decision on the emergency request when the brief was filed. Until the court acts, election offices must prepare for the possibility that the existing process or the proposed requirements could govern November mailings.

Raffensperger’s participation places Georgia among the states warning about administrative disruption from a late change. The filing is bipartisan and includes officials responsible for running elections at both state and local levels.
